South Korea criticises Obama's Apple veto - Financial Times

Samsung Electronics is continuing its efforts to seek punitive measures in the US against Apple for alleged patent infringement, despite the Obama administration's veto of a ruling in favour of the South Korean company.

On Saturday, President Barack Obama vetoed a June ruling by the US International Trade Commission that had ordered import bans on a range of Apple devices that it considered to infringe a patent held by Samsung.

Samsung revealed on Monday that it had already filed a court appeal against the original ITC ruling, because the ITC found that Apple had infringed only one patent, rather than the four Samsung claimed.

The appeal was filed on July 28 at a federal appeals court, a Samsung spokesman said. He was not immediately able to say whether the court had agreed to hear the case.

Samsung's appeal revives the possibility of US action against Apple devices including the versions of the iPhone 3GS, iPhone 4, iPad 3G and iPad 2 3G distributed by AT&T.

In a letter explaining the decision to overturn the ITC's import ban on these products, Michael Froman, the US Trade Representative, said that it was driven by concerns about "the effect on competitive conditions in the US economy and the effect on US consumers".

Separately, the ITC is preparing to issue a ruling on Friday in response to complaints by Apple that Samsung has allegedly infringed the US company's patents.
