Taking up a public interest litigation saying that barricades on the road dividing Sectors 1 and 2, near the Chandigarh-Nayagaon border, were inconveniencing commuters and should be removed, the Punjab and Haryana high court on Tuesday granted a month's time to the Chandigarh administration to take a decision.
The division bench comprising chief justice Sanjay Kishan Kaul and justice Arun Palli, after observing that the petitioner, advocate Ranjan Lakhanpal, had already submitted a representation to the authorities, said, "We are of the view that the matter is of such a nature that the authorities concerned should take a call and they are really not justiciable."
The court made it clear to the administration that it should decide on the petitioner's representation within a month and communicate to him the decision whether it is possible to open the road now or not.
Lakhanpal informed the court that the barricade was set up during the days of terrorism to protect the Punjab chief minister whose residence is situated nearby.
It was also submitted that the road in front of the Haryana chief minister was also closed permanently so that no terrorist could escape after attack.
The petitioner said that now, after many years of the end of terrorism in Punjab, the closure of the road was unjustified. He said entry road's closure had been inconveniencing nearly one-lakh residents of Nayagaon.
