Micromax has promised to try to work out a patent deal with Ericsson, following a suit filed by the latter, claiming about Rs 100 crore in damages. The company had issued a statement saying that it would do its best to come to an agreement with Ericsson. According to tech website bgr.com, Micromax claims that Ericsson has failed to adhere to global commitments on providing 'standards-essential' patents on fair, reasonable and non-discriminatory (FRAND) terms. But it will attempt to draw out such an agreement with the company in the near future. According to this report in the Economic Times, Ericsson had said it was "taking legal action after three years of negotiations failed to yield a licence agreement on 'standards-essential' patents." The report added that the case was the largest patent suit in India's IT and telecom space. Ericsson claims that Micromax has consistently refused to license standards essential patents related to 3G, GSM and EDGE technologies that are owned by the company. According to a judge's order which endorsed an interim agreement between the two companies, Micromax will pay Ericsson between 1.25% – 2% of sale price as royalty per phone and tablet. The money will be deposited in the court until the dispute is finally settled. Times of India reported that "the agreement says that Micromax and Customs department will intimate Ericsson whenever a consignment of devices arrives at customs so that a representative from Ericsson can inspect it. It clarifies that once Ericsson conducts an inspection of each consignment and informs Customs it has no objection to its release, the same will be immediately handed over to Micromax so that it can take its custody."
