Red light for Nov auction losers - Daily Pioneer

Telecom companies which were unsuccessful or did not participate in the fresh 2G spectrum auction conducted in November last year will lose out on business. The Supreme Court on Friday directed them to cease operations "forthwith".

Following the February 2, 2012, decision of the court to cancel 122 spectrum licences, the suspended licences were allowed to continue under interim orders of the court till a fresh auction conducted by the Centre decided their fate.

Following the fresh auction held on November 12-14 last year, a Bench of Justices GS Singhvi and KS Radhakrishnan clarified that successful bidders were free to start operations in their respective circles. However, other telecom operators which adopted a wait and watch policy and pointed out loopholes in the fresh auction were asked to close shop. The companies were asked to pay the reserve price fixed for licences in the fresh auction.

The Bench directed unsuccessful telecom licensees — who either failed in the bid or refused to participate in auction — to "forthwith stop operations".  According to the apex court order, 21 licences of Sistema Shyam Teleservices (MTS), 16 permits of Telenor-controlled Uninor, 15 of Videocon and three CDMA permits of Tata Teleservices were to stand cancelled from January 18, affecting around 25 crore subscribers in the country. However, these companies would be free to bid in the next round of auctions, expected to be held in March.

The court further clarified that its February 2 decision will not come in the way of any litigation sought to be pursued by unsuccessful bidders who have complained against the Centre's decision to auction in the 900 MHz spectrum band only.

According to the court, this was never the subject matter of the case heard and decided by it while cancelling licences. In the November 2012 auction, five telecom operators — Bharti Airtel, Vodafone, Telenor-promoted Telewings, Videocon and Idea Cellular — had applied for participating. Sistema Shyam Teleservices had not participated while Videocon won spectrum in six circles, Idea won in eight and Telenor got spectrum in six circles.
